FOLLOWING IS A LETTER I INTENDED TO SEND JUDGE FRIEDMAN, THE FEDERAL JUDGE IN THE BLACK FARMER'S CASES KNOWN AS PIGFORD 1 and 2. OUR FAU CHAIR WANTED TO WAIT. HOWEVER, HERE ARE MY QUEZSTIONS.

Dear Judge Friedman,


We are writing to you today in the hope that by Martin Luther King Day you will rectify a serious constitutional violation that has occurred in your court 23 years ago, the Black Farmers Discrimination suit. We have a number of questions we need answered.


This nation was founded and a set to laws written to insure We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity. 


It is no coincidence that “establish justice” is the first criteria of this new nation.  You passed judgment on this matter some 23 years ago declaring the United States Government’s Department of Agriculture discriminated against black farmers. You revisited the unsolved circumstancesSome 66,000 of these farmers were denied Due Process. 


Unreasonable time frame guidelines were put in place for those farmers to appeal to the court for redress of grievances. Most farmers are country folk unfamiliar with rigorous stipulations put on by the United States government and it’s court system to redress grievances. 


These hurdles are put in place by well educated, mostly white lawyers. Farmers often work from sun up to sun down. Many have no internet, some lack educational backgrounds to adhere to white lawyer criteria. To add insult to injury unscrupulous lawyers and others have taken a lot of money from these black farmers to obtain financial redress of their grievances from what your court already decided was their right. 


Queen Mother Bernice Atchison, a widowed black female farmer in Alabama in her 80’s,  has spent close to ten thousand dollars going to Congress, your court, and other venues on behalf of her case, and the cases of  all black farmers. I understand you described her as “the Face of the 66,000 black Farmers”. 


Some of these carpetbaggers tried to charge farmers such as Rod Bradshaw of Kansas 35% of any fees collected. You already ruled on these cases but the United States Government refuses to adhere to your judgment


Our Declaration of Independence the very beginning of our fight for freedom states clearly states 


We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.-- All Men ( and women).  

  

Fourth Amendment - The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and  , shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Since those freed by the emancipation proclamation were promised 40 acres and a mule and developed farms for themselves and their community the states have used scurrilous means to take their lands once white men in and out of state and federal governments saw the value of these lands.          

 

QUESTIONS

1. Is the Department of Agriculture doing business on behalf of the United States Government guilty of Contempt of Congress? We want to see the judicial system do it’s job. No one, even the United States Government is above the law    

 

2. If, in fact, you identified Queen Mother Bernice Atchison as “The Face” of Black Farmers, should she not be funded to keep these people from trying to steal money from these people who your court ruled were, in fact, discriminated against?

    

3. Should your court orders relating to all discriminated farmers apply equally be they white, black, female, or other delineation? 

  

4. John Conyers' hearing revealed $130 million to  a law firm. How much money actually went to lawyers? I understand at least 10% of all fees paid went to lawyers? This is a travesty of Justice.

5. charged fees or percentages of fees collected. Farmers won the case in 1999 and lawyers were paid by the government to represent them. I understand from 

6. Rod Bradshaw was told to basically go to hell by Hendrickson - Need his full name, position, and exact quote Red.

7. I believe your court hired your former law clerks to represent Rod Bradshaw  of Kansas - is this a conflict of interest? How much did the court pay them? 

 

8. Why were the Black Farmers not allow the  Right of Discovery?

 

9.   Why were the Black Farmers Appeal Rights not allowed?

 

10. Why did the court the court allow ALL Representatives of The Black Farmers, with the exception of Bernice Atchinson, To be paid compensation for their efforts

 

11. Why have the Court Orders that came out of Judge Friedman's Court NOT been enforced?

 

12. We need a TRUE and CORRECT Accounting of every dime paid out in The Black Farmer Lawsuit be turn over for public release

 

13. Why Have ALL Class members NOT Been Paid

 

14. Why did Judge Friedman appointed Bernice Atchinson as the Voice of the 66,000 and tied her hands by Leaving her with no financial support or legal assistance?
